DWI First Offense Over .18
In the past, people charged with a first-time DWI would typically seek a reduction of the charges to a driving while ability impaired (DWAI). A DWAI is not a criminal conviction. However, under recent changes to New York law, anyone alleged to have over a .18 blood alcohol level may not receive such a reduction, even for a DWI first offense. Instead, prosecutors now seek misdemeanor convictions in such cases.
