New York Aggravated DUI Lawyer

Albany DUI Defense Attorney

In recent years, New York DWI laws have become tougher in many significant ways. It is a far greater risk today to face even a "basic" first-offense DWI charge without an experienced attorney. If you have been charged with aggravated DWI — or felony DWI — working with an aggressive defense lawyer may be the only way to avoid extremely serious consequences.

At the Law Offices of Mark J. Sacco, PLLC, we focus on criminal and traffic defense, including representation of people accused of any level of DWI. We also handle vehicular assault and vehicular homicide. To request a free consultation in the capitol district or elsewhere in New York, contact us now at our offices in Albany or Schenectady.

Why Am I Charged With Aggravated DWI, and What Does That Mean?

If you are facing a charge of aggravated DWI, the allegation is that you were driving with a blood alcohol content of 0.18 percent or higher — more than twice the legal limit, which is now .08 percent.

Though still a misdemeanor, aggravated DWI carries more serious penalties than a 'standard" charge of driving while intoxicated. For a first offense, fines commonly exceed $1,000 and the minimum driver's license suspension is one full year. The law also allows for a jail sentence of up to one year. If you have had any prior DWAI or DWI convictions within the past 10 years, the consequences are dramatically more severe.

Equally important, being charged with aggravated DWI may exclude you from promptly seeking a reduction to the lesser charge of DWAI — once a common defense approach.

Skilled in Negotiation or in Taking Your Case to Trial

Attorneys Mark J. Sacco and James E. Tyner are thorough, aggressive DWI defense lawyers who will look at every aspect of your arrest. We will aggressively seek grounds to challenge BAC test results, the validity of your traffic stop, training of officers who tested you, or other factors.

If negotiation with prosecutors can benefit you, we will pursue that path. No matter what, you will have a proven trial lawyer on your side. We urge you not to go it alone when charged with aggravated DWI. Instead, contact us now and request a free consultation.
