Recent Changes to New York Traffic Laws

In New York, the legislature, courts and prosecutors are getting tough on drunk drivers. In recent years, major changes have occurred that have resulted in harsher penalties and consequences for people caught drinking and driving.

If you have been charged with DWI/DUI, it is critical to retain an experienced New York DWI attorney who will provide a vigorous defense on your behalf. Even a DWI first offense can result in significant consequences. If you are charged with drinking and driving in New York, the Law Office of Mark J. Sacco, PLLC can help.

DWI First Offense Over .18

In the past, people charged with a first-time DWI would typically seek a reduction of the charges to a driving while ability impaired (DWAI). A DWAI is not a criminal conviction. However, under recent changes to New York law, anyone alleged to have over a .18 blood alcohol level may not receive such a reduction, even for a DWI first offense. Instead, prosecutors now seek misdemeanor convictions in such cases.

Now more than ever, it is critical for people charged with a DWI in New York to seek experienced legal representation.

Other Recent Changes

Just three years ago, New York's legal limit was .10. Like many states around the nation, New York's legal limit is now a .08. Whereas a refusal to take a chemical test formerly resulted in a six-month license suspension, the term of license suspension is now a full year. Moreover, a second DWI conviction within 10 years of a previous DWI conviction is now a felony and can result in a lengthy prison term.
